A Shift of power from Authority to Average The Inaugural Address is one of the most important speeches a president will make in their term. This speech sets the tone of how a president will govern the people of America. Each president will not have 100% support from every single citizen. Donald Trump, man-made millionaire, was the Republican candidate for the 2016 Presidential Election. In his Inaugural Address he made promises to the American people that he would give power,jobs,protection, and patriotism back to them. In particular this occurs when working in small discussion groups, when having to make a presentation or when involved in social, political or environmental action. This document is about what you need to know and the skills that you need to develop in order to do that well. 1. FEELING SAFE What comes up I wonder what comes up for you when you find yourself in a group? Some of the feelings will probably be: Who are these people? Will I like them? Will they like me? What if someone criticises me? Or it could be: This should be fun. I’m looking forward to this. I might learn something new here. I might make new friends. Probably it will be a mix of the two. But notice that in each case what comes up are quite strong feelings. This is normal – for everyone. The important thing is to pay attention to them, to listen to them, to see what they tell you about yourself. The affective (feeling) domain is equally as important as the cognitive (thinking) domain in social experience. Some of the feelings you will have when first in a group will be to do with safety. Does it feel OK to be here? Are these people I want to be with? If you have chosen who you are with this may partly be on the basis of how safe you feel with them, supported and respected by them. Remember other people will be having similar feelings to your own. 1 Ground rules It is difficult to work well with others in a group if you are feeling insecure, setting up a framework which helps give a sense of security to the group is thus essential. This involves agreement on what are called ‘ground rules’. Ground rules should be agreed by the group members themselves. Here are five essential ones. Speaking – only one person speaks at a time, this could be as a result of putting a hand up or agreeing to take turns to speak. Listening – it is important to really listen to what the other person is saying without interrupting them. Not judging – it is really important to listen without making judgements about the other person, this is where they are coming from, respect that. Sharing – no one person should dominate the discussion, no person should be left out, everyone should be encouraged to contribute. Voice – it’s not about saying the right thing or having an answer, it’s about ‘finding your voice’, which may be just to say what you’re feeling. The group task The most important thing in a task orientated group is to reach agreement on the goal and how best to achieve it. There is always a tension between individual/group needs that has to be resolved. You may thus have to put some of your own needs aside in order to achieve the set task. This does not mean ignoring them. You might want to take it in turns at the beginning just to say how you feel about being in the group before getting down to the task. Q: Is there anything you need to do before you can be really present to what we’ve got to do? 2. DISCUSSION SKILLS Sharing feelings It often really helps the group dynamic to periodically check-in with how you are feeling about the task. You might therefore make observations such as: â€Å"I feel really excited about working together on this†; â€Å"I feel really daunted about the task we have to do†; â€Å"I feel nervous about having anything valuable to contribute†. Such statements don’t necessarily require an answer but they do reveal what is going on for you. Others know where you’re at and can then take this into account. Feelings are kept out in the open which, if not 2 expressed, might hinder achievement of the task. They may also often strike a chord of sympathy with others. Sharing opinions For a group to achieve its task everyone needs to contribute, this means everybody needs to share their thoughts and opinions in the group. Two things may happen at first: i) you may feel you don’t have anything to say; ii) you may be nervous about sharing your ideas with others. Firstly, whatever the topic you will have some responses to it, so spend a moment or two jotting down any questions, ideas, experiences which you feel may be relevant. Secondly, it is quite alright to be tentative about what you first say. It is often only in the process of discussion that your ideas will begin to become clear. Remember to hold your certainties lightly, i. e. whilst stating your opinion about a particular issue you may still find you want to refine or alter it later. Similarly other people’s starting points may not be where they finish up. Active listening Don’t be afraid to remind the group of the ground rules for by remembering these the group will feel a safer place in which to experiment and try out ideas. Everyone has a shared responsibility here. Active listening means really listening to what someone is saying whether you agree with them or not. It means not interrupting or spending the time thinking about your answer. It is also really helpful to check out with the speaker that you have understood correctly what they are saying. This can best be done by paraphrasing what you feel they have said and reflecting that back to them. What I heard you say was†¦Ã¢â‚¬  The speaker then knows she has really been heard or can clarify any points if she needs to. When everyone feels really listened to and respected achievement of the group’s task will be much easier and more fun. 3. REACHING AGREEMENT Working co-operatively If your group is following all of these strategies – and it does take practice – you are well on the way to good co-operative working. Co-operative working involves considering different ways to set about the task and 3 agreeing on the best one. If you feel safe in the group you are less likely to mind about making compromises sometimes. Working co-operatively does not mean that everyone has to agree. You may work co-operatively and supportively to identify the main differences of opinion on an issue and to really clarify the arguments for and against different opinions. Co-operative working also means working to bring out the best in others. Difficulties and disagreements However well a group gets on there will still be difficulties and disagreements. If someone’s behaviour upsets you what should you do? First, remember the ground rules! Second, you need to share how you are feeling. There is a crucial difference between saying â€Å"You really annoy me when you play around in the group† (blaming) and â€Å"I find it difficult to focus on the task when you play around† (ownership of your own feelings). On some issues discussion may get heated and someone may need to use the ground rules to cool things down. You might say â€Å"Let’s take a few minutes out to reflect on what’s happening here. Is there a more constructive way in which we could move this forward, I wonder? † It is also fine to disagree! No one is suggesting that everyone in the group must have the same opinion on how best to do something. However, if it is a collective task, e. g. a seminar presentation, everyone will need to agree on how to share this out and work effectively together. Staying on task It always helps to stand back occasionally and watch what is going on in a group. Is someone dominating conversation, is someone staying quiet, is the group getting off task? It is always important and helpful to feed your observations back to the group. ‘Keeping on task’ can have both a narrow and a broad interpretation. You may feel that conversation is straying from the task and topic under discussion and decide to draw attention to this. You might be right, but what appears to be straying off course can sometimes lead to fruitful insights and a sharpened perception of the issue. Developing these skills will take time, you will make mistakes that you can learn from, and you will try again. Gradually you will find that working in a group is less daunting than you may have thought, that you do have something to contribute, and that ‘synergy’ begins to occur – this is when 4 the insight and output of the group begins to feel more than the sum of its individual parts. In the years of past the United States has intervened in many overseas wars and dilemmas. On the warrant that the United States believes their values and ethics are the beliefs of the world. Darfur would be one example where the United States should keep to its own borders. Darfur is being called in a state of genocide by some. In ?Genocide Is Occurring in Darfur? an article by Andrew B Lowenstein, he states ?To be found culpable for genocide, one must commit certain criminal acts, such as killing or causing serious bodily or mental harm; and - this is a key part - these acts must be committed with the specific intent to destroy, in whole or in part, a national, ethnic, racial, or religious group?(p1). Is the United States not doing this in Iraq? Has United States not single out one ethnic religious group and committed mass killings against them? So this begs the question, why is United States not accused of genocide? In the United States if murder is committed, that person is arrested and put on trial for his or her crime. With undeniable proof he or she is sentenced to prison and in some states the death penalty. Then that person can make many appeals towards their case. For a person on death role it takes a lot of years before that person is put to death. Lowenstein interviewed many people from Darfur, he claims a male survivor told him a Janjaweed leader said ?kill all the blacks in this area?(p2). Lowenstein also claims a female told him she heard ?kill? the ?Zaghawa people?(p2). Lowenstein being an international lawyer should know eyewitness accounts are not very reliable. Everyone sees an event a different way or here?s what was said and put in their own words. Lowenstein does not provide any real hard evidence that genocide is being performed in Darfur, just what some people have told him. Lowenstein never entered Darfur borders. Lowenstein states, ?The U.N.?s decision was particularly significant. Unlike other groups, which merely failed to weigh in the question, the United Nations affirmatively declared that the Sudanese government had not committed genocide?(p1). So United States could enter Darfur borders and start a war on the basis of he said or she said, that?s just what it would be, United States starting a war. Darfur has done nothing to United States, has posed no threats or made any accusations to do harm to the United States. In ?The United States Should Not Intervene in Darfur? by Justin Raimondo he adds, to lend a helping hand the United States should grant more visas, leave politics to their own country and hold American morals to its own boundaries (p4). The United States (for whatever reason) feels their ethics and morals should be that of the world, but why should it, is it because United States is the strongest and economical country in the world? So does this give the United States the right to say do it our way or we will kick your ass? That?s the problem with power; over time it becomes a controlling factor that one?s way is the only way. In trying to save Africa, (because that?s what the United States would call it) what effect would it have on the American people? The Iraq war and Desert Storm war have driven the price of oil to skyrocketing prices. Making the American people pay higher prices at the fuel pumps. The five largest imports in 2009 from Africa were mineral oil, oil, cocoa, wood, rubber and electrical machinery (ustr.gov). In a writing career that spanned more than half a century, Agatha Christie wrote 79 novels and short story collections (Dubose 42). Agatha Miller was born in Torquay, England on September 15, 1980 to a rich, loving family. Her father died when she was a child. Though long and term frequently serve together as a phrasal adjective, as in â€Å"long-term goals,† in this sentence, they are an adjective and a noun, respectively, and hyphenating them is an error: â€Å"Those organizations that adapt will be able to excel in the long term.† 2. NASA officials recommend viewing the eclipse through specially-made glasses to prevent eye damage. What is perhaps the most common type of error of intrusive hyphenation is as a result of confusion between phrasal adjectives and phrasal adverbs. Homelessness and the Failure of the Welfare System - Essay Example In his time on the streets, he speaks of Billy Jack, a longtime homeless person who has recently gotten out of jail after five years. For him, being homeless is a matter of pride and a sense of place. He panhandles, he drinks wine, and he waits every morning for the Sally Ann truck to come by with breakfast and clothing. He is settled in his routine. The Parkdale recreation centre in Toronto is a shelter for the homeless, but, according to Stackhouse, public opinion does not consider these people homeless. Some have mental problems; some, such as Jim, have at least a part-time job. Jim works to supplement his disability income and believes that working is a way to be healthier. What constitutes a homeless person Is it simply a matter of not have a mailing address or is it based on income Stackhouse says: When I had set out a week earlier to live homeless, I did not expect to be eating pancakes and sausage for breakfast and pastries before bed, or to earn $20 an hour simply by sitting on the ground with a cardboard sign in front of me (233). On the other side of the coin, Stackhouse goes on to mention his surprise at how much crack passes through the shelters considered representative of public goodwill. He also makes note of the fact that as he moves from one shelter to another, he is apt to see the same people, who are also moving. Some shelters are better than others, for instance in an affluent area of Toronto, Stackhouse talks with an overnight guest, who apologizes for being there and says he knows he shouldn't be. He has a truck, hauls scrap metal to dumps, and makes about $600 to $700 a week. The problems, Stackhouse has discovered, are more psychological than physical and often not related to simply shelter for the homeless. To be homeless, according to Stackhouse, is to be without a stable environment. He quotes one homeless man in this affluent shelter who says: "This is a real traditional neighborhood (comparing it with his transient existence). I bet these people never have to go anywhere" (232). Refutation of Opposing Argument It is said by some that the homeless do not have the resources, opportunities and skills they need to go back to the main society. Jack Layton, president of the Federation of Canadian Municipalities, offers a more academic view of homelessness in his rebuttal of Stackhouse's article. But instead of looking at the specific details of Stackhouse's experience, Layton makes this a personal vendetta, ignoring the underlying implications in the reporter's series. The situations referred to by Layton are that, after one week outdoors, Stackhouse claims, according to Layton, that public resources are used by crack dealers, that beggars earn professional wages and that there is "more free food than the homeless can eat" (Layton, 235). Although Layton implies that he is quoting from the article, the phrase about free food is not even in it, which immediately weakens his argument. Layton does admit that emergency shelters alone are not the answer, but his only reference to the personal aspects of the homeless is their need for more respect. He seems to consider money and

Social contracts usually contain a basic set of laws and agreements explaining how the country should be run. Examples of a Social contract are the US constitution and the Declaration of the Rights of Man. John Locke was a huge influence for both of these documents. Locke also believed that every person has natural rights. A natural right is a basic right that every citizen should be born with. Locke said that everyones natural rights were the right to â€Å"life, liberty, and property. † These natural rights have been quoted and used many times in history. Thomas Jefferson was influenced by this while writing the Declaration of Independence, saying that all men are created equal and that they have the right to life, liberty, and the pursuit of happiness. Lastly and most importantly, Locke believed in the right of revolution. The right of revolution is the belief that if that a government does not meet the basic needs and wishes of its people, then the people have the right to revolt and overthrow that government. Examples of this are the American and French revolutions. The Americans revolted against England because they failed to grant them the basic rights stated in their social contract, saying no taxation without representation. The French revolted against their government because King Louis caused the countries economy to be almost non existent and most of the country had nothing to eat. Both these revolutions led to the rise of democratic nations. John Locke is one of the most influential people in history. His beliefs has influenced the formation of many countries, including our own. His ideas have be restated and reused throughout history, and still influence people today.

ercy Bysshe Shelley ( /? p? rsi ? b li/;[2] 4 August 1792 – 8 July 1822) was one of the major English Romantic poets and is critically regarded as among the finest lyric poets in the English language. Shelley was famous for his association with John Keats and Lord Byron. The novelist Mary Shelley was his second wife. He is most famous for such classic anthology verse works as Ozymandias, Ode to the West Wind, To a Skylark, Music, When Soft Voices Die, The Cloud and The Masque of Anarchy, which are among the most popular and critically acclaimed poems in the English language. His major works, however, are long visionary poems which included Queen Mab (later reworked as The Daemon of the World), Alastor, The Revolt of Islam, Adonais and the unfinished work The Triumph of Life. The Cenci (1819) and Prometheus Unbound (1820) were dramatic plays in five and four acts respectively. Although he has typically been figured as a â€Å"reluctant dramatist†, he was passionate about the theatre, and his plays continue to be performed today. He wrote the Gothic novels Zastrozzi (1810) and St. Irvyne (1811) and the short prose works â€Å"The Assassins† (1814), â€Å"The Coliseum† (1817) and â€Å"Una Favola† (1819). In 2008, he was credited as the co-author of the novel Frankenstein (1818) in a new edition by the Bodleian Library in Oxford and Random House in the U. S. entitled The Original Frankenstein, edited by Charles E. Robinson. [3][4][5] Shelley's unconventional life and uncompromising idealism[6][7], combined with his strong disapproving voice, made him an authoritative and much-denigrated figure during his life and afterward. *Kicks his football up against the house wall* I never used to be able to do this. I can do it now though obviously. Me and my dad spent a whole afternoon practising my kicking. â€Å"The side of your foot it goes long, the tip of your foot it goes high.† he would say. I never got what he meant at first. I could kick it far but not high. The first time I went to kick it high like dad told me to, I fell over onto my back. It really hurt. My eyes were watering but my dad always told me that big boys don’t cry. He grabbed the ball off me and booted it higher than my bedroom window! I can’t remember the last time me and dad spent the day together. He’s always working, or down the pub, or going out with his fancy bird Jenny. *George doesn’t kick the ball in time and it rolls behind him. He puts his finger up into the air* Emirates Stadium. Dad got us 2 tickets for the Arsenal v Man U match. Well 3 actually. Jenny came. She wouldn’t stop moaning! â€Å"David, I’m cold. David, how long until we can go home? David. David. David.† The moaning ruined it. She ruined it. The only time she shut up was when dad had his tongue half way down her throat. *Puts his fingers down his throat* BLERGH! He never used to do that with mom. They would always shout a lot. When I would go to bed I used to have to put my pillow over my head so I couldn’t hear them. It didn’t help. It sounded like I was under water and they were squawking like seagulls. *Shakes his head to get rid of the memories* She can do much better than dad. She’s really pretty and makes the best cheese on toast EVER! She puts that Worcestershire sauce on it. Mr Spink didn’t like it when he tried it though. Mr Spink is my teacher at school. He got a crush on my mom. When me and mom went to parents evening he kept giving her googly eyes. Mom didn’t like him that much. She was doing her â€Å"you’re a very nice man†¦.but no† face. While he was chatting mom up, I snuck off and changed the bell clock so it rang for the next parents to have their meeting. Mom noticed me by the bell as she left. She winked, took my hand and we walked to the car, not looking back at Mr Spink. â€Å"Cheeky Monkey.† She said to me as she got into the car with a smile on her face. I asked her if she fancied Mr Spink. She said I was as bonkers as Granny Cat Face. *Rolls his eyes* She’s dad’s mom. She’s really called Ermintrude but me and mom call her Cat Face because she’s spent so much time with her evil cats that her face always looks like a cat’s when it’s just drank some milk that’s slightly off. *Makes a face like Granny Cat Face’s. He scrunches up his mouth * We went round for Sunday dinner a while ago and she started trying to clasp one of those annoying teeny tiny flies that fly into your face in her big meaty hands. She looked just like a cat clawing a ball of yarn. Me and mom couldn’t stop laughing. We haven’t been invited back since. Mom’s making dinner now. Chicken nuggets, chips and beans. Mom doesn’t make fancy food. Dad used to moan about always having the same food. I don’t. I like chicken nuggets. Mom doesn’t seem to be as angry now as she was when dad was around. Her hair used to go all curly and her cheeks would go red but not now. Now she looks pretty and wears make up and has hair like David Beckham’s wife. *George’s phone vibrates. He checks his phone* Billy’s going to come and knock for me at 1 o’clock so we can go and play football round his. His big sister’s so cool. *Looks up at the camera then carries on kicking the ball* She’s called Kate and she’s 17. She spiked mine and Billy’s hair for us. Then she had to take some pictures of us for her beauty course. We started modelling in the garden for her. My foot got caught under one of the concrete slabs and I fell over. Billy’s sister took me inside, cleaned my cut and put a plaster on it. She said I was really brave and even the best models fall over at times. I don’t like Billy’s mom though. She makes me eat me eat vegetables when I go round and always asks how mom’s coping without dad and if they’re going to get back together. I hope they don’t. They weren’t very happy. It’s a bit sad not seeing both of them on my birthday but I get 2 lots of presents. And besides, mom said her and dad both love me but it’s just hard to stay together when you argue so much. *The door bell rings* Billy’s at the door so I better go. E1v). Tropes are further divided into tropes of words and sentences, and schemes are also divided into grammatical and rhetorical schemes. Grammatical schemes deviate from customs of speaking and writing and are subdivided into orthographical and syntactical schemes. Biography of Norman Rockwell, American Painter Norman Rockwell was an American painter and illustrator best-known for his  Saturday Evening Post  covers. His paintings depict real American life, filled with humor, emotion, and memorable faces. Rockwell shaped the face of illustration in the mid-20th century and with his prolific body of work, its no wonder hes called Americas Artist. Dates:  February 3, 1894–November 8, 1978 Rockwells Family Life Norman Perceval Rockwell was born in New York City in 1894. His family moved to New Rochelle, New York in 1915. By that time, at age  21, he already had a foundation for his art career. He married Irene OConnor in 1916, though they would divorce in 1930. That same year, Rockwell married a school teacher named Mary Barstow. They had three sons together, Jarvis, Thomas, and Peter and in 1939, they moved to Arlington, Vermont. It was here that he got a taste for the iconic scenes of small-town life that would make up much of his signature style. In 1953, the family moved a final time to Stockbridge, Massachusetts. Mary passed away in 1959. Two years later, Rockwell would marry for the third time. Molly Punderson was a retired teacher and the couple remained together in Stockbridge until Rockwells  death in 1978. Rockwell, The Young Artist An admirer of Rembrandt, Norman Rockwell had a dream of being an artist. He enrolled in  several art schools, starting with The New York School of Art  at 14 before moving on to The National Academy of Design when he was just 16. It wasnt long before he moved on to The Arts Students League.   It was during his studies with Thomas Fogarty (1873–1938) and George Bridgman (1865–1943) that the young artists path became defined. According to the Norman Rockwell Museum, Fogarty showed Rockwell the ways of being a successful illustrator and Bridgman helped him out with his technical skills. Both of these would become important elements in Rockwells work. It did not take long for Rockwell to start working commercially. In fact, he was published many times while still a teenager. His first job was designing a set of four Christmas cards and in September 1913, his work first appeared on the cover of  Boys Life.  He continued working for the magazine through 1971, creating a total of 52 illustrations. Rockwell Becomes a Well-Known Illustrator At the age of 22, Norman Rockwell painted his first  Saturday Evening Post  cover. The piece, titled Boy with Baby Carriage appeared in the May 20, 1916, issue of the popular magazine. Right from the start, Rockwells illustrations carried that signature wit and whimsy that would make up his entire body of work.   Rockwell enjoyed 47 years of success with the Post. Over that time he provided 323 covers to the magazine and was instrumental in what many called The Golden Age of Illustration. One could say that Rockwell is easily the best-known American illustrator and most of this is due to his relationship with the magazine. His depictions of everyday people in humorous, thoughtful, and sometimes wrenching scenarios defined a generation of American life. He was a master at capturing emotions and in observing life as it unfolded. Few artists have been able to capture the human spirit quite like Rockwell. In 1963, Rockwell ended his relationship with the  Saturday Evening Post  and started a ten-year stint with  LOOK  magazine. In this work, the artist began to take on more serious social issues. Poverty and civil rights were at the top of Rockwells list, though he did dabble in Americas space program as well. Important Works by Norman Rockwell Norman Rockwell was a commercial artist and the amount of work he produced reflects that. As one of the most prolific artists in the 20th century, he has many memorable pieces and everyone has a favorite. A few in his collection do stand out, though. In 1943, Rockwell painted a series of four paintings after hearing President Franklin D. Roosevelts State of the Union address. The Four Freedoms addressed the four freedoms Roosevelt spoke of in the midst of World War II and the paintings were appropriately titled Freedom of Speech, Freedom of Worship, Freedom from Want,  and Freedom from Fear. Each appeared in the  Saturday Evening Post,  accompanied by essays from American writers. That same year, Rockwell painted his version of the famous Rosie the Riveter. It was another piece that would fuel patriotism during the war. In contrast, another well-known painting, Girl at the Mirror in 1954 shows the softer side of being a girl. In it, a young girl compares herself to a magazine, throwing aside her favorite doll as she contemplates her future. Rockwells 1960 work entitled Triple Self-Portrait gave America a look into the quirky humor of the artist. This one depicts the artist drawing himself while looking in the mirror with paintings by the masters (including Rembrandt) attached to the canvas.   On the serious side, Rockwells The Golden Rule (1961,  Saturday Evening Post) and The Problem We All Live With (1964,  LOOK) are among the most memorable. The earlier piece spoke to international tolerance and peace and was inspired by the forming of the United Nations. It was gifted to the U.N. in 1985.   In The Problem We All Live With, Rockwell took civil rights on with all his painterly might. It is a poignant picture of little Ruby Bridges flanked by the headless bodies of U.S. marshals escorting her to her first day of school. That day marked the end of segregation in New Orleans in 1960, a monumental step for a six-year-old to take on. Study Norman Rockwells Work Norman Rockwell remains one of the most beloved painters in America. The Norman Rockwell Museum in Stockbridge, Massachusetts was established in 1973, when the artist gave most of his lifes work to the organization. His goal was to continue to inspire arts and education. The museum has since become home to over 14,000 works by 250 other illustrators as well. OBJECTIVES OF PROPOSED SYSTEM: The new methodologies should be developed and then it will be implemented in the different software industry with techniques and the results will be compared. New software size estimation methods should be developed. These methods will help in software cost estimation by using the different estimation techniques. These new methods will be better in software cost estimating, particularly for in the environment of Pakistan. There should be easier methods for Software development in the Agile with Scrum Model. It is comparison of old and new technologies. In the environment of Pakistan these approaches will be valid for software cost estimation. FUTURE WORK: Developing the new methodologies for software creation is an emerging trend in the environment of Pakistan. The approaches for software size, code, space and time estimation will be applied on the different software estimation techniques. Basically, the methodology proposes an integrated usage of available all these estimation techniques in different phases of the development life cycle. Application of the methodology in developing software by SD approach is also discussed. As a next step, the methodology should be experimented in various projects and thus will be enhanced. Some applications are also needed for applying the methodology to other software development approaches such as object-oriented development, Jackson System Development Programming (JSD JSP) etc. Also, the tool needs to be ported to UNIX environment. Review of Literature: Artem Marchenko, Pekka Abrahamsson (2008): The authors carried out an ethnographically informed longitudinal case study in industrial settings and closely followed how the Scrum method was adopted in a 20-person department, working in a simultaneous multi-project RD environment. Altogether 10 challenges pertinent to the case of multi-team multi-project Scrum adoption were identified in the study. The authors contend that these results carry great relevance for other industrial teams. Steve Berczuk (2007): Stated main reason that it is difficult to do work in agile with distributed teams is that distribution can reduce communication bandwidth. Co-located teams that dont communicate well can also fail with agile methods. But the rules of agile methods serve to increase communication and feedback. Any team is best served by following the rules of the agile method with as few adjustments as possible. Distribution increases the damage that non-compliance can cause. If the team feels like it owns the process and the tools it is more likely to be able to overcome obstacles and be successfull. Andrew Begel, Nachiappan Nagappan (2006): This paper report on the results of an empirical study conducted at Microsoft to learn about Agile development and its perception by people in development, testing, and management. They found that one-third of the study respondents use Agile methodologies to varying degrees, and most view it favorably due to improved communication between team members, quick releases and the increased flexibility of Agile designs. Barry Boehm, Richard Turner (2005): Their discussions with traditional developers and managers concerning agile software development practices nearly always contain two somewhat contradictory ideas. They find that on small, stand-alone projects, agile practices are less burdensome and more in tune with the software industrys increasing needs for rapid development and coping with continuous change. Wilton, P. and J. W. Colby(2005). Stated that most database management systems these days are relational with implementing agile methodology, termed relational database management system . These systems make storing data and returning results easier and more efficient. They allow different questions to be posed of the database even questions the original designer of the database didnt expect to be asked. Outi Salo (2004): Empirical results are reported from two XP (Extreme Programming) projects where the project teams conducted post-iteration workshops after all process iterations in order to improve and optimize working methods. Andreas Kornstadt and Joachim Sauer (2002) It includes discussion of the diary-driven development lightweight approach to documentation and providing a technique of introspection to help peer-review yourself. The experience reported on also covers what happens when you try to take these techniques successfully applied by an individual and scale them up for adoption by a typical small team. Adding relevance to a non-technical management audience, the presentation looks at these practices from a risk-mitigation viewpoint. It will help validate them as worthwhile for solo developers and debunk the idea that software engineering is only for big teams. Highsmiths J.A.(2000): The research project described in their report is three-pronged effort to investigate the issues associated with Scrum adoption. First, the practices that characterize the Scrum agile method will be stated, along with common variants. Second, projects that have adopted, or are in the process of adopting, Scrum will be surveyed to identify which Scrum practices, or variants thereoff, they have implemented and the perceived value of the method. Third, factors affecting Scrum adoption will be investigated. The objective of this research is to better understand the barriers to adoption and the leverage points that might encourage Scrum to be more widely and efficiently deployed. Boehm. B(2000) l: The paper proposes the component paradigm as a way to bridge the gap between model-driven and agile development. Service-based component concepts applied at the level of modeling, architectural design and development can ensure and strengthen agile development principles and practices. Components provide a way of building simple and flexible software architecture that can easily scale in size and level of details in order to overcome certain limitations of agile development processes. Material Methods This research is an empirical study .The existing published literature and research material, relevant to the Agile and scrum model are the first treasure of knowledge for this research study and provide the baseline to execute the research in proper direction. Online digital libraries and databases e.g. ACM, Springer link, IEEE etc, are the main source of information. Due to the fact that this is relatively a new research domain with insufficient academic research contribution I will also approach the online articles, success stories, case studies and personal experiences, shared by Agile practitioner, through the search engines. I will approach the agile practitioners who have experienced the Agile methodologies in distributed/Offshore environment[10]. And various research groups e.g. Google groups, Yahoo groups etc, relevant to the research topic, for getting the research input. I will also survey different organizations, especially in Pakistan, for getting the multiple responses, close ended and open ended questionnaires will be published to capture the views of IT professionals.. After approaching the wider group of Agile practitioners to get the general view point. In order to become more focused, I identify the group which are very specific and practically working in the particular development environment (Distributed agile)[8]. Structured and semi structured interview will be another tool to refine the respondent findings. The results will be formulated for this empirical study on the basis of theoretical frame work (literature review) and empirical study (survey and interviews with practitioners) The key to scrum is planning the date of completion for production or release, prioritizing functionalities, Identifying available resources, decision about the architecture. Scrum offers a collection of empirical techniques that assume existence of uncertainties but provide practical and specific techniques to tame Iterative [9], Incremental and Adaptive Software Development Model. In scrum Project work is identified dynamically and prioritized according to the customers needs and what the team can do. Introduction The purpose of this technical report is to communicate the results of the Pneumatic Tyre Characteristics laboratory by investigating the effect of cornering force on slip angle. Presently our sales associates are highly capable of assisting customers in choosing the right product for an intended purpose, however there is a need to retrain our sales team so that in addition to addressing the customers intended purpose, they can determine the customers physical condition or body type and recommend a product that ideally suits the customer. Why does U.A need to retrain its Sales Associates? No two individuals can ever be same so a product that suits one person’s body type may not necessarily suite the others body type. For instance when a customer asks for a pair running shoe, our sales associates will be capable of showing them the complete range of running shoes, and then let the customer take his pick. In order to guarantee customer satisfaction it is essential to determine the customers foot type, whether he/she has a supinator, pronator or neutral arched foot 3. This knowledge will help the sales associate to recommend a shoe that is most likely to provide optimal fit and maximize performance. In the same way other products such as inner wear need to confirm to the wearer’s physical condition in order to ensure an optimal fit and comfort, hence a retraining programme is required to develop these skills among our sales associates. The concept of providing high level technical assistance to buyers will serve as an addition to the company’s U.S.P’s (Unique Selling Points), this may lead to increase in company’s retail sales. Major Concerns related to the retraining programme A primary concern related to the retraining programme is that, it will effect the operations across several departments. Revision and up gradation of the existing product training programme will require collaborated effort from product design department and the training department hence this may effect normal operations of the product design department, however the advantages of the retraining programme will far outweigh minor inconveniences that shall be encountered in the process of implementing this idea. Concerns about the training programme hampering the store operations can be taken care of by dividing the sales associates into maximum number of small batches, this will ensure that sufficient staff is available at the store while each batch in turn undergoes intensive product training. It is hoped that the retraining programme will help in creation of a highly skilled sales force capable of providing the customers with a unique shopping experience.

1. Trust vs. Mistrust- This mother displays affection, and adequate care giving to her child. By providing a child with this throughout their first year of life, you show that they can depend on you. This forms a bond of trust between mother and infant, rather than mistrust. 2. Autonomy vs. Doubt- This child is three years old; he has progressed from diapers to the adult sized toilet. After going to the bathroom, he knows he must wash his hands. His mother sees that he wants to do it himself, but is slightly frustrated that he is not tall enough. This mother could just pick him up and assist him, making him feel like he couldn’t do it. She buys him a small step stool, and supervises him washing his hands also providing positive reinforcement. 3. Initiative vs. Guilt- This set of parents notice that their five year old boy greatly enjoys wrestling with his older brothers. They sign him up for karate lessons so he can enjoy himself, but do it in a safe way. 4. Industry vs. Inferiority- A mother is sewing inside her living room. The mother tells her ten year old daughter she is making a scarf. The phone rings, and the mother answers and leaves the room. Her daughter, wanting to be just like mommy, cut up the curtains to make her mother a dress. Her mother re-enters the room, smiling and thanking her daughter for picking such a pretty fabric for her dress. The mother continued to help her make the dress. 5. Identity vs. Identity Confusion- This seventeen year old girl has had a very good life. Her parents have always been supportive in everything she has done. Now that she has reached her adolescence, she believes she might know who she is. Throughout her life, she has taken dance lesson, art class, done musical theatre, painting, singing lessons and many other things in the artistic field. She feels her true passion in life is for art and painting, and she may want to pursue a career in that field. 6. Intimacy vs. Isolation- Now that this woman has reached adulthood, she wants to begin searching for a lifetime partner. She meets a nice man in the mall, though he doesn’t call her for two weeks she doesn’t get discouraged. They go on many dates, become a couple and eventually after two years of dating decide to get married. 7. Generatively vs. Stagnation- After getting married, a man and a woman discuss what they plan to do with their lives. They decide he will continue working, and they want to have a child. She does not want to stay at home forever though, so they agreed that when the time is right she would get a part time job. 8. Integrity vs. Despair- A man is in his late sixties, and gets called an â€Å"old man† for the first time. He realizes that he wasted his whole life working and not enjoying himself, he wants to feel young again. He sells his house in New York and moves to Florida. He finds himself a young girlfriend, and parties like he’s in his twenties again.

Breach of Covenant That Was Present †Free Samples for Students

In the present case, the facts given in this question revealed the presence of the issue if puters Pty Ltd can successfully sue Systems Pty Ltd for the breach of covenant that was present in the employment contract of Chu with puters Pty Ltd. This issue has arisen as a result of the fact that after his retirement, a pany, Systems Pty Ltd was incorporated by Chu's wife. This pany has been taking on Business Law from the clients of puters Pty Ltd. in NSW while restrictive covenant present in the employment contract of Chu provides that he cannot join any business that petes with the pany for 2 years in NSW. Therefore, it needs to be seen in this case if puters Pty Ltd can take action against Systems Pty Ltd for the breach of this covenant. 1. It appears that in the present case, as soon as Chu took retirement from the pany, he had decided to start a business that was going to pete with puters Pty Ltd. However, in order to fulfill this objective, a pany under the name of Systems Pty Ltd had been formed by Chu's wife. She is the sole director of the pany and also holds all the issues the capital in the pany. This pany is taking the business of puters in New South Wales. The legal principle was provided in Salomon v Salomon according to which it was affirmed that after it's incorporated, generally panies considered as a separate legal entity that is distinct from its shareholders. In this way, the principle of separate legal identity of the corporation has been followed in Anglo Australian panies’ law for more than 100 years. Therefore, when a pany acts, it acts on its own and not simply as alias for the persons controlling the pany (Clarke and Clarke, 2016). In the same way, the shareholders of the corporations cannot be held labor regarding the debts of the corporation beyond the initial capital investment. Similarly, they do not have any proprietary interest in the assets of the pany. In Jones v Lipman (1962), the defendant had entered into a contract for selling his land. However, later on he changed his mind. Therefore, the defendant found the pany and he was the owner/director of this pany. The land was transferred to this corporation and the defendant declined to perform the transaction. As a result, the relief was sought by the plaintiff. In this case, the court stated that the remedy of specific performance can be granted against the contracting vendor, because it was in his authority to force the other person to convey the property in question. Therefore, specific performance was ordered against the director and the pany. The court held that the pany cannot escape or divest itself from the knowledge that has been gained by it through the director. The court stated that the pany was a creature of the controlling director or a device or a mask that the director holds before his face for the purpose of avoiding recognition by equity. However, there are certain circumstances where the court may arrive at the conclusion that the corporate veil needs to be pierced in a particular case. Therefore, while basic principle provides that under the corporation’s law, a pany is treated by the law as having its own separate legal identity. And as a result, it is considered to be distinct from its members. But as time passed by, the courts have e up with several exceptions to the application of this general rule. As a result, now under some circumstances, it is available to the court to set aside the fact that the pany enjoys a separate personality and concludes that the members of the pany can be held responsible for its actions. When such a decision is made by the court, it is said that the court had decided to lift the corporate veil (Khoury and   Yamouni, 2010). The facts of Gilford Motor pany Ltd v Horne (1933) are somewhat similar to the problem given in the present case. In this case, Mr. Horne was working as the managing director of the Gilford Motor pany. After he left the pany, he decided to incorporated his own pany. Therefore, after the entire production of his pany, he started to solicit the clients of Gilford Motor Co. on the other hand, there was a non petition covenant present in his employment contract. Therefore, the issue was if the actions of Mr. Horne's pany can be considered as a breach of the non petition covenant present in his employment contract. However, the court decided that this amounted to the breach of covenant and granting an injunction against Mr. Horne and his pany. In support of its decision, the court stated that the pany incorporated by Horne was merely a cloak that had been used by Horne for the purpose of breaching the non petition covenant. A somewhat similar decision has also been given by the court in J ones v Lipman (1962). Therefore in Gilford Motor Co v Horne, the defendant was the ex-MD of the plaintiff. However, there was a restrictive covenant present in his employment contract. In view of this clause present in the employment contract, he was refrained from joining a business in petition with his former employer. Therefore in order to avoid this covenant, the defendant formed a pany and he tried to transact his business through this pany. Therefore, at the first instance, the court held that this pany has been formed for the purpose of allowing the business to be carried on under the control of the defendant but without injuring the liability for the breach of the covenant. That was present in his employment contract. In this way, the court noted, the reality that this pany was being used by the defendant as a channel through which he was performing his business in breach of the covenant. In such a case, it can be said that the pany has been formed only as a cloak or sham due to the reason that in reality the business was being carried on by Chu. Due to the reason that the restrictive covenant prevented Chu from peting with the business of puters Pty Ltd. whether as principal or, while acting as an agent for another party, it was not relevant if the business belonged to him or the belonged to his wife, provided that the business was being carried on by Chu. The only significance of the interposition of the corporation was to maintain the pretense that the business was being continued by other person. Therefore, in such a case it can be said that there is no doubt on the basis of the present facts that the pany formed by Chu's wife was created for the purpose of acting as a channel through which Chu was going to carry on his business that will pete with the business of puter Pty Ltd. Although under the corporations law , it has been provided that a pany has to be considered as a separate legal entity that is distinct from those who manage the affairs of the pany, but in the present case, it can be said that it was one of the reasons behind the creation of the pany by Chu's wife was the fear that Chu may be held responsible for the breach of the covenant and with the help of the formation of this pany, he may be able to avoid liability if he acted through the pany. On these grounds, it can be said that this pany has been formed merely as a device or a stratagem for the purpose of acting as a mask to effectively carry on the business of Chu. In the present case also, puters Pty Ltd is required to establish in the court that the new pany, Systems Pty Ltd had been formed only with a view to evade the application of the restrictive covenant present in the employment contract of Chu according to which he cannot pete with puters Pty Ltd for a period of two years in New South Wales. Hence the court may decide that the corporate veil should be lifted in this case and the restrictive covenant in the employment contract of Chu needs to be enforced against the pany created by Chu’s wife, Systems Pty Ltd. At the same time, as puters had created a subsidiary pany and the benefit of the restrictive covenant can also be provided to this pany.
